Entitlement and conditions

  • 8The covered services include property-related expert services, accommodation, rights to use property and construction coordination. Either supplier or recipient must be outside India, and the services must span multiple territories without agreed separate values.

Procedure, powers and definitions

  • 8Territorial proportions are determined by applying rule 4 with necessary changes.
  • 8The law does not settle the corresponding changes needed when applying the imported rule while preserving this rule’s express scope.

Rule 8 allocates specified immovable-property services across States or Union territories where either the supplier or recipient is outside India. It applies when the services span more than one territory and no agreement separately determines territorial values. The rule imports the allocation provisions of rule 4 with necessary changes, while retaining its own stated scope for the services and parties.[1]
