Section 10 permits eligible registered persons to opt for a prescribed composition amount instead of tax under section 9(1). The main option uses preceding-year aggregate turnover and category-specific rate ceilings, with limited services permitted. A separate option covers qualifying persons ineligible for the main scheme. Eligibility restrictions, common-PAN conditions, turnover-triggered lapse and penalties for ineligible payment accompany both options.[1]

Both options override contrary provisions of the Act but remain subject to reverse charge under section 9(3) and (4). The credit prohibition in sub-section (4) overrides section 16 and accompanies the bar on collecting tax from recipients. The explanations distinguish turnover for eligibility from turnover for calculating tax, while the section 73, 74 or 74A machinery determines ineligible-payment consequences.

Section 10 has been in force since 22 June 2017. Main-option wording and the increased statutory ceiling changed from 1 February 2019; sub-section (2A) and explanations followed from 1 January 2020. Services-related changes began on 1 January 2021, with omissions from 1 October 2023. The services proviso applies from 1 February 2019 and its Explanation from 1 January 2020. Footnote 14 gives no commencement date for the section 74A insertion.

Frequently asked questions

Does composition remove reverse-charge requirements?

No. Both options expressly remain subject to section 9(3) and (4), despite overriding contrary Act provisions. Their replacement amount concerns section 9(1) tax.

Section 10(1) and 10(2A)

May a composition person collect tax or take credit?

No. Sub-section (4) bars collection from recipients and input tax credit for both options. The credit bar overrides the section 16 entitlement.

Section 10(4)

When does the composition option lapse?

It lapses on the day current-year aggregate turnover exceeds the limit for the applicable option. Sub-section (3) applies to both the main and separate options.

Section 10(3)

Do pre-registration supplies enter both turnover calculations?

They enter eligibility aggregate turnover from the first day of April until registration liability, but are excluded from the turnover used to calculate composition tax. Both calculations exclude the specified exempt interest or discount services.
