Police, Railways, Customs, land revenue and State or Union territory tax officers must assist proper officers in implementing the Act. Land revenue officers include village officers. The Government can also notify other classes of officers whose assistance the Commissioner may call upon. This extends the classes covered; the law does not define the practical boundaries of assistance.[1]

Unsettled questions

The words of section 72 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Does the duty in sub-section (1) arise of itself, or only when a proper officer asks for assistance? Sub-section (1) says the officers "shall assist" and says nothing of a request, while sub-section (2) expressly requires a call from the Commissioner for other classes.
  2. What does it take to "assist the proper officers in the implementation of this Act"? The section requires assistance and gives no test of what assistance is, so the boundary between assisting and acting as a proper officer is undrawn.
