Procedure, powers and definitions

Section 39 requires electronic returns from specified classes of registered persons and sets the relationship between returns and payment. General returns cover inward and outward supplies, input tax credit availed, tax and other particulars. Separate rules govern composition persons, tax deductors, Input Service Distributors and non-resident taxable persons, with prescribed form, manner and timing or stated deadlines.[1]

The section permits notified quarterly classes and extensions, while retaining monthly payments for quarterly filers and quarterly payments for composition persons. Returns remain required for periods without supplies or deductions where stated. Rectification excludes discoveries through specified authority activity and has an outer cutoff. Missing earlier returns or same-period outward details restrict filing, alongside a three-year limit, both with notification exceptions.

Section 39 has been in force since 1 July 2017. Return and payment changes took effect from 10 November 2020 and 1 October 2022; the three-year limit began on 1 October 2023. General-return conditions changed from 1 October 2025. Substitutions in footnotes 6 and 8 remain pending; footnote 11 gives no commencement date for the tax-deduction return change.

Unsettled questions

The words of section 39 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Which financial year fixes the thirtieth day of November in the proviso to sub-section (9)? The wording in force says only "following the end of the financial year". The substitution that would read it as "the financial year to which such details pertain" is footnote 8, which the source records as not yet enforced, and the main limb of the sub-section fixes the return by the month or quarter in which the defect is noticed, which may fall in a different year.
