At a glance

Section 7 defines supply inclusively for the Act. It covers supplies for consideration in business, specified dealings between a non-individual person and its members, imports of services for consideration, and Schedule I activities without consideration. It also classifies supplies as goods or services and excludes Schedule III activities and notified public-authority activities through an overriding rule.[1]

Sub-section (2) overrides sub-section (1), so its exclusions govern even where an activity meets an inclusion. Schedule II classification under sub-section (1A) depends on an activity first constituting supply under sub-section (1). The Government's classification power is subject to sub-sections (1), (1A) and (2). The member-dealing Explanation separately overrides contrary laws and judgments by deeming the parties separate persons.

Section 7 has been in force since 1 July 2017. The member-dealing clause and its Explanation operate retrospectively from that date, although brought into force on 1 January 2022. Sub-section (1A), omission of clause (1)(d), and the related wording changes also operate retrospectively from 1 July 2017, although brought into force on 1 February 2019.

Frequently asked questions

Does an imported service need a business connection under clause (b)?

No. Import of services for consideration is included whether or not in the course or furtherance of business. Consideration remains required by that clause.

Section 7(1)(b)

Can an activity within Schedule III remain supply under sub-section (1)?

Sub-section (2) overrides sub-section (1) and treats Schedule III activities as neither goods nor services supplies. The exclusion governs the inclusion.

Section 7(2)(a)

How strong must an indirect business connection be?

The law does not settle the strength of connection required by the phrase "in the course or furtherance of business". Clause (a) requires that connection together with consideration and the other stated elements.

Unsettled questions

The words of section 7 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. What makes an activity in the course or furtherance of business, where the link to the business is indirect? The Act defines business but not the strength of the connection this phrase requires.
