Procedure, powers and definitions

  • 118(1)Appeal a Principal Bench order, or a High Court judgment under section 117 certified fit immediately after judgment on the Court’s initiative or an aggrieved party’s application.
  • 118(2)–(3)Apply Civil Procedure Code appeal rules so far as possible and implement Supreme Court variations or reversals through the section 117 mechanism. Section 119 preserves payment despite appeal.
  • 118The law does not settle who is aggrieved or how immediately after judgment applies to a certificate or application made after an interval.

The Supreme Court appeal route covers Principal Bench orders and High Court appeal judgments certified fit for further appeal. Civil Procedure Code appeal rules apply so far as possible. A Supreme Court reversal or variation must be implemented through the High Court judgment mechanism. Section 119 preserves the payment requirement despite filing an appeal to the Supreme Court.[1]

Unsettled questions

The words of section 118 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Clause (b) lets the High Court take up the certificate "on an application made by or on behalf of the party aggrieved" and the Act nowhere says who is aggrieved by a judgment or order. This is the same silent question the section 107 record routes to this position, and it is cited here rather than written a second time.
  2. Clause (b) speaks of a certificate given "immediately after passing of the judgment or order" and the Act nowhere says what that requires. It does not say whether a certificate applied for or given later is outside the clause, whether the requirement attaches to the application or to the certificate, or what becomes of an appeal where the High Court takes up the question after some interval.
