GST›CGST Act, 2017›Chapter XVI, Liability to Pay in Certain Cases

At a glance

Bars, duties and time limits

  • 86An agent supplying or receiving taxable goods on behalf of a principal and that principal are jointly and severally responsible for the tax on those goods.

Procedure, powers and definitions

  • 86The law does not settle whether taxable goods means goods in a taxable supply, goods not wholly exempt, or goods with a notified rate.

An agent and principal bear joint and several responsibility for tax on taxable goods supplied or received by the agent on the principal’s behalf. The trigger covers both supply and receipt. The Act defines agent, principal, goods and taxable supply, but the expression taxable goods used here is not defined, leaving its precise reach unsettled.[1]

Unsettled questions

The words of section 86 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Section 86 fastens the liability on the supply or receipt of "any taxable goods". The Act defines "goods" (clause (52) of section 2) and "taxable supply" (clause (108) of section 2), but nowhere defines "taxable goods". Does the expression mean goods forming part of a supply leviable to tax under this Act, or goods that are not wholly exempt, or goods of a description on which a rate has been notified?
