GST›CGST Act, 2017›Chapter VII, Tax Invoice, Credit and Debit Notes

At a glance

Section 34 permits credit notes where invoiced value or tax is excessive, goods are returned, or supplies are deficient. It requires debit notes where invoiced value or tax is understated. Notes may cover supplies in a financial year and must contain prescribed particulars. Their details enter the issue-month return, with a deadline and reduction conditions applying to credit notes.[1]

The original tax invoices and issue-month returns link note issue with adjustment of liability. The proviso to sub-section (2) restricts a supplier's output-tax reduction by recipient credit reversal or passed-on tax incidence. The proposed discount ground links section 15 but remains pending. The Explanation includes supplementary invoices within debit notes for the Act.

Section 34 has been in force since 1 July 2017. Multiple-invoice and multiple-note wording began on 1 February 2019; the November deadline began on 1 October 2022. The output-tax reduction proviso was substituted from 1 October 2025. The 2026 insertion making the specified section 15 discount a credit-note ground awaits notification and remains pending.

Unsettled questions

The words of section 34 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. How is the supplier to establish that the recipient has reversed the input tax credit attributable to the credit note, when the Act gives him no means of seeing the recipient's ledger?
  2. What makes goods or services or both "found to be deficient" for the purposes of sub-section (1)? The sub-section makes deficiency a ground and gives no test for it.
