  • 168AThe law does not settle the scope of other calamities or how the implementation qualification applies across the listed events.

The Government can extend statutory, prescribed or notified time limits where force majeure prevents completion or compliance. The power operates notwithstanding the Act and requires a notification on Council recommendations. A notification may act retrospectively, but not earlier than the Act’s commencement. The definition lists calamities while leaving the boundary of other calamities and their implementation effect unsettled.[1]

Unsettled questions

The words of section 168a do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. What is an other calamity caused by nature or otherwise affecting implementation within the section 168A Explanation, and how does that implementation qualifier operate across the enumerated events? The text supplies no mechanical classification standard.
