GST›CGST Act, 2017›Chapter VI, Registration

At a glance

Section 30 permits a registered person whose registration the proper officer cancelled on the officer's own motion to apply to that officer for revocation. The application follows prescribed manner, time, conditions and restrictions. The officer may revoke or reject by order, but rejection requires a hearing. Revocation under the State or Union territory GST Act is deemed revocation under this Act.[1]

Section 29 supplies the cancellation on which this remedy depends. Sub-section (2) follows an application under sub-section (1), and its hearing proviso limits rejection. Its further proviso subjects revocation itself to prescribed conditions and restrictions. Sub-section (3) links the State and Union territory outcome to this Act, while rule 23 supplies the referenced application and order procedure.

Section 30 has been in force since 22 June 2017. From 1 October 2023, the application wording moved to prescribed time and a former proviso was omitted. Footnote 3 identifies the further revocation-conditions proviso by the Finance (No. 2) Act, 2024 dated 16 August 2024, without stating a commencement date. The former omitted proviso is not preserved.

Unsettled questions

The words of section 30 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. What does an opportunity of being heard require? Proposed in the section 28 record of this batch; the first proviso to 30(2) uses the same words.
