Bars, duties and time limits

Procedure, powers and definitions

Section 17 restricts input tax credit to the part attributable to business purposes and taxable supplies, including zero-rated supplies. It also denies credit for specified goods, services and tax payments, subject to stated exceptions. Those blocked-credit rules override the entitlements in section 16(1) and section 18(1), even where the expenditure otherwise relates to business.[1]

The section defines the value of exempt supply for attribution and gives specified financial institutions a monthly credit option. Separate clauses govern vehicles, vessels, aircraft, employee benefits, construction and other blocked categories. Construction has an expanded meaning, while plant and machinery has express exclusions. The Government may prescribe how credit is attributed between the relevant uses.

Section 17 has been in force since 1 July 2017. Vehicle and benefit clauses changed from 1 February 2019; corporate social responsibility and exempt-value changes took effect from 1 October 2023. The plant and machinery substitution is retrospective from 1 July 2017, with further explanations from 1 October 2025. Footnote 6 gives no commencement date for the section 74 change.

Unsettled questions

The words of section 17 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. What makes a use of goods or services a use "for the purpose of any business"?
  2. Does the proviso that follows clause (b)(iii) reach clause (b)(ii) as well? It is placed after clause (iii) but speaks of "such goods or services or both", and clauses (ii) and (iii) are joined by "and".
  3. What makes construction of an immovable property "on his own account" under clause (d)? The clause turns on the phrase and nowhere defines it.
  4. What is use "for personal consumption" under clause (g), and whose consumption counts? The clause blocks the credit on the phrase alone and the Act does not define it.
