Section 50 of the CGST Act, 2017

GST›CGST Act, 2017›Chapter X, Payment of Tax

At a glance

Section 50 requires a person who fails to pay tax within the prescribed period to pay interest on their own for the unpaid period. It also requires a registered person to pay interest on input tax credit wrongly availed and utilised. Government notifications set the respective rates on the Council's recommendations, within the statutory ceilings.[1]

The delayed-tax rule has a ceiling of eighteen per cent. and starts calculation on the day after tax was due. Its proviso uses the cash-ledger portion for specified late returns, except returns furnished after the named proceedings commence. The credit rule has a twenty-four per cent. ceiling, requires both wrong availment and utilisation, and uses prescribed calculation.

Section 50 has been in force since 1 July 2017. The proviso to sub-section (1) and sub-section (3) were substituted retrospectively from that date, although brought into force on 1 June 2021 and 5 July 2022 respectively. Footnote 3 gives no commencement date for the later section 74A insertion, so its effective date remains unstated.

Unsettled questions

The words of section 50 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. When is input tax credit that has been wrongly availed also "utilised"? Sub-section (3) charges interest only where both have happened and nowhere says what utilisation is.
