Section 31 requires registered suppliers to issue tax invoices for taxable goods and services at the applicable times, with prescribed particulars. It also governs revised invoices, bills of supply, receipt and refund vouchers, and reverse-charge documents. Continuous supplies, services ending early and goods sent on approval have specific timing rules, while notified categories may follow alternative documentation requirements.[1]

Sub-section (3) overrides the ordinary goods and services invoice rules in sub-sections (1) and (2). The approval-goods rule in sub-section (7) separately overrides sub-section (1). Continuous-service timing remains subject to the advance receipt-voucher rule. Supply timing uses invoice dates, while sections 9 and 10 select the reverse-charge and composition document requirements respectively.

Section 31 has been in force since 1 July 2017. The services-notification proviso was substituted from 1 January 2021. Footnote 2 inserts a prescribed period for recipient invoices and includes deduction-only registrants within "supplier who is not registered", but states no commencement date. The footnote identifies the Finance (No. 2) Act, 2024 dated 16 August 2024.

Unsettled questions

The words of section 31 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. When is it established that "subsequently no supply is made" against an advance payment for which a receipt voucher was issued? The clause makes the refund voucher turn on that fact and fixes neither a time by which the conclusion is drawn nor a time within which the voucher is issued.
