Entitlement and conditions

  • 158A(2)Obtain supplier consent for all categories. Obtain recipient consent for invoice, outward-supply and movement-document details, and for additional prescribed details where these include recipient identity, in the prescribed form and manner.

Bars, duties and time limits

  • 158A(3)Notwithstanding other laws, no action lies against Government or the portal for liability consequent on sharing under this section; tax liability on the supply or return is unaffected.

Procedure, powers and definitions

  • 158A(1)Subject to consent and prescribed conditions, the portal may share registration, return and annual-return particulars, invoice preparation data, outward supplies, movement-document data and other prescribed details with notified systems, notwithstanding sections 133, 152 and 158.
  • 158AThe law does not settle whether sharing a multi-recipient statement requires every recipient’s consent or only consent from those whose details are shared.

The common portal may share specified registered-person details with notified systems on Council recommendations and prescribed conditions, notwithstanding sections 133, 152 and 158. Supplier consent is required, with recipient consent for the specified details and identity-linked additional information. The section also protects Government and the portal from consequential liability claims despite other laws, while preserving the underlying tax liability.[1]

Unsettled questions

The words of section 158a do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Clause (b) of sub-section (2) requires the consent "of the recipient", in the singular, for details furnished under clause (b) of sub-section (1). Those details — the particulars uploaded for preparation of invoice, the details of outward supplies furnished under section 37, the particulars uploaded for generation of documents under section 68 — ordinarily relate to many recipients at once. Where they do, must the consent of every recipient to whom the details relate be obtained before any of them may be shared, or only the consent of the recipient whose details are actually to be shared? The clause fixes neither, and the difference decides whether a whole statement of outward supplies can be shared at all.
