GST›CGST Act, 2017›Chapter V, Input Tax Credit

At a glance

Section 20 requires a supplier's office receiving input-service tax invoices for or on behalf of distinct persons to register as an Input Service Distributor and distribute the credit. The invoices include the stated reverse-charge services. Distribution covers central and integrated tax under prescribed requirements, with credit passed under the specified tax heads through a document stating its amount.[1]

Section 25 identifies the distinct persons, while section 24(viii) supplies the registration requirement. Section 9 and section 5 of the Integrated Goods and Services Tax Act identify the reverse-charge services, with same-State payment relevant under sub-section (2). Distribution must also be read with section 21 on credit distributed contrary to section 20, and with the prescribed distribution and document rules.

Section 20 has been in force since 1 July 2017. The whole section was substituted from 1 April 2025. Insertions covering Integrated Goods and Services Tax Act reverse-charge services also took effect from 1 April 2025 under the Finance (No. 7) Act, 2025. The insertion shares the substitution's effective date, while its enactment date is not given.

Unsettled questions

The words of section 20 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. What makes a tax invoice for an input service one that an office receives "for or on behalf of" distinct persons, rather than for its own use? The sub-section turns the whole obligation on the phrase and nowhere says how the two are told apart.
