Unsettled questions

The words of section 28 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. What does an opportunity of being heard require? The proviso forbids rejection without one and nowhere says what one is: whether a notice alone suffices, what time must be allowed, and whether a personal hearing must be offered. The same words appear in the first proviso to section 29(2) and in the proviso to section 30(2), and this one position answers all three.
