Entitlement and conditions

  • 132(1)(a)–(f)Offences include deliberate supply without invoice to evade tax; invoices without supply causing wrongful credit or refund; credit on those invoices or fraudulently without invoices; collected tax unpaid beyond three months from its due date; residual evasion or fraudulent refund; and false books, documents or information intended to evade tax.
  • 132(1)(h)–(l)Knowing dealings in confiscable goods or contravening service supplies, and attempts or abetment of the retained offences, are covered. The opening words also reach causing offences and retaining their benefits.
  • 132(4)–(6)Despite the Criminal Procedure Code, offences are non-cognizable and bailable except clauses (a) to (d) punishable in the highest band. Those are cognizable and non-bailable. Prosecution needs previous Commissioner sanction.

Bars, duties and time limits

  • 132(1)(i)–(iv)The stated amount bands permit five years and fine above five hundred lakh rupees, and three years and fine above two hundred lakh up to five hundred lakh. Only clause (b) has the one-year-and-fine band above one hundred lakh up to two hundred lakh. Clause (f) permits six months, fine or both.
  • 132(2)–(3)A second or subsequent conviction permits five years and fine. The specified band and repeat sentences have a six-month minimum unless the judgment gives special and adequate contrary reasons.

Procedure, powers and definitions

  • 132 ExplanationTax includes evasion, wrongful credit or refund under central, State, integrated and Union territory GST laws and compensation cess.
  • 132The law does not settle aggregation of overlapping amounts, punishment for other offences in the lowest band, the interaction of clause (f) with amount bands, or whether repeat conviction requires the later offence to follow the earlier conviction.

Specified GST offences carry imprisonment and fines, with monetary bands, a repeat-conviction rule and prior Commissioner sanction. Residual evasion covers conduct outside the earlier clauses. Despite the Criminal Procedure Code, offences are generally non-cognizable and bailable, except specified serious invoice, credit and collection offences. The minimum sentence has a judicial-reasons exception, and several interactions between punishment clauses remain unsettled.[1]

Unsettled questions

The words of section 132 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Where more than one of the amounts clauses (i) to (iii) name — the tax evaded, the input tax credit wrongly availed or utilised, the refund wrongly taken — arises out of the same offence, are they added together to make the amount those clauses operate on, or is each tested against the bands on its own? The clauses write the three in the alternative and say nothing about the case.
  2. Where the amount exceeds one hundred lakh rupees but does not exceed two hundred lakh rupees and the offence is not one specified in clause (b), does sub-section (1) provide any punishment at all? Clause (iii) is confined to clause (b) by the substitution footnote 8 made, clauses (i) and (ii) begin above two hundred lakh rupees, and no clause reaches the case.
  3. Does clause (iv) displace clauses (i) to (iii) for an offence specified in clause (f) whose amount exceeds one hundred lakh rupees, or do the bands apply to it as they do to any other offence? Clause (iv) fixes no amount and clauses (i) and (ii) are confined to no clause of sub-section (1).
  4. Does sub-section (2) reach a later conviction for an offence committed before the earlier conviction, or only one for an offence committed after it? The sub-section fixes no order between the earlier conviction and the later offence.
