At a glance

Entitlement and conditions

  • 99Subject to Chapter XVII, the appellate body constituted under a State or Union Territory GST Act is deemed to be the Appellate Authority under this Act for that territory.

Procedure, powers and definitions

  • 99The law does not settle which forum receives an appeal or disagreement reference where no such appellate body has been constituted.

The Appellate Authority for Advance Ruling constituted under a State or Union Territory GST Act also serves under this Act for that territory, subject to Chapter XVII. It receives appeals and references when the original Authority’s members differ. The section does not identify an alternative forum where the relevant State or Union territory has not constituted the appellate body.[1]

Unsettled questions

The words of section 99 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Which body is the Appellate Authority for the purposes of this Act in respect of a State or Union territory for which no Appellate Authority for Advance Ruling has been constituted under that State's or that Union territory's own Act? The section deems an existing body to be the Appellate Authority and provides for no other, so where the deeming has nothing to work on the Act names no forum for an appeal under section 100 or a reference under sub-section (5) of section 98.
