Procedure, powers and definitions

Section 37 requires registered persons within its scope to furnish outward supply details electronically for each tax period. The ordinary deadline is the tenth day of the succeeding month, with prescribed conditions, restrictions, form and manner. Details must also be communicated to recipients. Input Service Distributors, non-resident taxable persons and persons paying under sections 10, 51 or 52 are excluded.[1]

The section permits notified extensions and requires correction of errors or omissions, with tax and interest where short payment results. Rectification has an earlier-of deadline, alongside a historical extension. Missing earlier outward supply details restrict later filing, and a three-year limit restricts delayed furnishing. The Government may notify exceptions to the latter restrictions on the Council's recommendations.

Section 37 has been in force since 1 July 2017. Sub-section (2), the former first proviso to sub-section (1) and words in sub-section (3) were omitted from 1 October 2022. That date also brought the November rectification cutoff and earlier-period filing restriction. The three-year filing limit took effect from 1 October 2023; the historical extension dates from 31 December 2018.

Unsettled questions

The words of section 37 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. In which return must the tax and the interest on a short payment discovered under sub-section (3) be paid: the return for the tax period to which the erroneous details relate, or the return for the period in which the error or omission was discovered and rectified? The words "in the return to be furnished for such tax period" carry both readings and the section settles neither.
