  • 80Liability self-assessed in any return is excluded from this facility.

Procedure, powers and definitions

  • 80On application, the Commissioner may give written reasons for extending time or allowing no more than twenty four monthly instalments, subject to prescribed conditions and section 50 interest.
  • 80The law does not settle whether self-assessed liability later confirmed or increased by an order retains its excluded character.

A taxable person may ask the Commissioner to extend payment time or permit monthly instalments, altering the ordinary payment period under section 78. The facility excludes liability self-assessed in a return and remains subject to section 50 interest and prescribed conditions. Default on any instalment makes the entire outstanding balance immediately recoverable without a further notice.[1]

Unsettled questions

The words of section 80 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Where an amount was first shown as the liability the person self-assessed in a return and was afterwards confirmed or increased by an order of determination, is the amount still "the amount due as per the liability self-assessed in any return" and so outside this section, or is it now an amount due under an order and inside it? The section carves out the self-assessed liability without saying at what moment, or by reference to which document, the character of an amount is fixed.
