GST›CGST Act, 2017›Chapter V, Input Tax Credit

At a glance

Section 19 gives the principal input tax credit on inputs and capital goods sent for job work, subject to prescribed conditions and restrictions. Direct dispatch to the job worker can qualify without prior receipt at the principal's premises. The section also deems supply when specified return or onward-supply requirements are not met within the applicable period, with stated exclusions.[1]

Sub-sections (2) and (5) override the section 16(2)(b) receipt condition for direct dispatch. Section 143 identifies the principal and provides the onward-supply route for inputs under sub-section (3). The direct-dispatch provisos change the period's starting point to job-worker receipt. Sub-section (7) overrides the deeming rules in sub-sections (3) and (6) for the specified moulds, dies, jigs, fixtures and tools.

Section 19 has been in force since 1 July 2017 under Notification No. 09/2017-Central Tax, made under section 1(3) of the Act. The section carries its commencement note without later amendment markers. Its direct-delivery entitlements, time periods, counting provisos and exclusions form part of that wording from commencement for inputs and capital goods sent for job work.

Unsettled questions

The words of section 19 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Nothing in section 19 was found to be left open in a way the statute does not itself close. The periods, the deeming, the counting rule in each proviso and the exclusion in sub-section (7) are all stated.
