Section 44 of the CGST Act, 2017

From the IndiaAuditLens Law Library

GST›CGST Act, 2017›Chapter IX, Returns

At a glance

Section 44 requires persons within its scope to furnish an electronic annual return, which may include a self-certified reconciliation statement comparing declared supplies with audited annual financial statements. Prescribed time, form and manner apply. The section excludes specified registrants and audited public bodies, permits notified class exemptions, and places a three-year outer limit on filing subject to a notified exception.[1]

The first proviso lets the Commissioner exempt classes on the Council's recommendations, while the second excludes qualifying government departments and local authorities from the section. Sub-section (2) limits the return required by sub-section (1), with Government power to permit later filing. Annual-return furnishing also links to the rectification and credit-note limits in the related provisions.

Section 44 has been in force since 1 July 2017. The whole section was substituted from 1 August 2021. That wording became sub-section (1), and the three-year filing limit with its notification exception was inserted from 1 October 2023. The earlier audit-linked annual-return requirements belong to the pre-substitution wording preserved in the amendment history.
