Procedure, powers and definitions

Section 18 provides for input tax credit when registration or the tax treatment of supplies changes. A person may take credit for specified stock and, in some cases, capital goods, subject to prescribed conditions and restrictions. The section also permits transfer of unutilised credit on specified business reorganisations and requires payment when certain changes or capital-goods supplies occur.[1]

The registration clauses use different stock dates, while leaving composition or an exemption can bring capital goods within the credit calculation. A one-year invoice limit restricts credit under sub-section (1). Entering composition or becoming wholly exempt requires payment and lapse of the remaining credit balance. Supplying capital goods generally requires the higher of reduced credit and transaction-value tax.

Section 18 has been in force since 1 July 2017. The CBIC text carries only the commencement footnote, with no later amendment marked. Credit under sub-section (1) and payment under sub-section (4) are calculated as prescribed. The separate capital-goods supply rule uses prescribed reductions and transaction value under section 15, with an exception for the specified goods supplied as scrap.

(d) where an exempt supply of goods or services or both by a registered person becomes a taxable supply, such person shall be entitled to take credit of input tax in respect of inputs held in stock and inputs contained in semi-finished or finished goods held in stock relatable to such exempt supply and on capital goods exclusively used for such exempt supply on the day immediately preceding the date from which such supply becomes taxable:

Provided that the credit on capital goods shall be reduced by such percentage points as may be prescribed.

Frequently asked questions

Do the registration clauses use the same stock date?

Clause (a) uses the day before liability to pay tax begins; clause (b) uses the day before registration is granted. Both concern inputs in stock and inputs in semi-finished or finished goods.

Section 18(1)(a) and (b)

Which capital goods qualify when an exempt supply becomes taxable?

Clause (d) requires capital goods to have been used exclusively for the exempt supply. They must be held on the day before the supply becomes taxable, and credit is reduced as prescribed.

Section 18(1)(d)

Does every reorganisation require specific transfer of liabilities?

The law does not settle whether that qualification covers every listed mode or only the immediately preceding business transfer. The transfer entitlement concerns credit remaining unutilised in the electronic credit ledger.

Section 18(3)

What happens to remaining credit after entering composition?

The remaining electronic credit ledger balance lapses after the payment required by sub-section (4). That payment uses the specified stock and capital-goods amounts at the preceding day.

Unsettled questions

The words of section 18 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Does "with the specific provisions for transfer of liabilities" qualify every mode of change in sub-section (3), or only the transfer of the business that immediately precedes it? The sub-section lists six modes and attaches the phrase once, at the end, without saying which of them it governs.
