GST›CGST Act, 2017›Chapter III, Levy and Collection of Tax

At a glance

Section 8 determines tax liability where a supply is composite or mixed. A composite supply comprising two or more supplies, one of which is principal, is treated as that principal supply. A mixed supply comprising two or more supplies is treated as the particular supply attracting the highest rate of tax within that mixed supply.[1]

The choice between the clauses depends on whether the bundle is composite or mixed. Section 2 supplies the definitions of composite supply, mixed supply and principal supply. Clause (a) then follows the principal supply, while clause (b) follows the highest-rate supply. Section 9 uses this treatment in the levy, and the linked Integrated Goods and Services Tax Act provisions use the classification.

Section 8 has been in force since 1 July 2017 under Notification No. 09/2017-Central Tax, made under section 1(3) of the Act. Its commencement note carries that date, and no amendment footnote marks a later change to either clause. The composite-supply and mixed-supply rules are the wording applicable from that commencement.
