Procedure, powers and definitions

Section 140 permits specified registered persons to bring eligible existing-law credit into the electronic credit ledger. Separate limbs address return balances, unavailed capital-goods credit, stock held on the appointed day, later-received inputs or services, fixed-rate taxpayers and centralised registrations. It also addresses Input Service Distributor services, reclaim after payment, prescribed calculation and the eligible-duty and tax definitions.[1]

Each entitlement depends on its own existing-law status, credit admissibility, documents and timing. The stock alternatives and mixed taxable-exempt limb cross-refer to other sub-sections rather than operating independently. Sub-section (7) overrides contrary Act provisions for its distributor credit. Explanation 3 restricts the duty-and-tax lists by excluding the stated cesses, while changes to the definitions' sub-section coverage remain pending.

Section 140 has been in force since 1 July 2017. The in-force amendments are expressed with effect from that date, including changes brought into force on 1 February 2019 and 18 May 2020 and the later distributor-invoice wording. Footnote 10 marks the substitutions of Explanation coverage as not yet enforced, so those changes remain pending despite their printed wording.

Unsettled questions

The words of section 140 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Which Explanation, if any, defines the expression "eligible duties" for sub-section (1)? Footnote 1 inserted those words into sub-section (1) and is in force from 1 February 2019 with effect from 1 July 2017. Explanation 1, which defines the expression, is expressed to apply to the sub-sections that footnote 10 substitutes, and the source records footnote 10 as "not yet enforced" while nevertheless printing the substituted words. The section therefore uses an expression in sub-section (1) that, on the served text read with its own footnote, may have no definition in the section at all.
  2. Is "the appointed date" in clause (ii) of the proviso to sub-section (1) the same day as "the appointed day"? The Act defines "appointed day" in clause (10) of section 2 and nowhere defines "appointed date"; clause (ii) is the only place in the section that uses the second expression, and the six months of returns the clause requires are counted back from whichever day it means.
  3. Is the credit under sub-section (8) allowed where the return for the period ending with the day immediately preceding the appointed day was furnished later than three months after the appointed day? The first proviso attaches the original-or-reduced-revised-return condition to a return furnished within three months and says nothing at all about a return furnished later; the sub-section itself imposes no time for furnishing it.
