At a glance

Bars, duties and time limits

  • 121Proceedings under section 73, section 74 or section 74A, as applicable, must be initiated for credit wrongly availed in whole or in part.

Procedure, powers and definitions

  • 121Amounts credited under rule 117(3) may be verified.

Rule 121 permits verification of transitional amounts credited under rule 117(3). If credit has been wrongly availed, wholly or partly, proceedings must be initiated under section 73, section 74 or section 74A, as applicable. The reference to these provisions makes the applicable determination procedure relevant to recovery; the rule does not itself decide whether a particular credit claim was wrong.[1]
