Entitlement and conditions

  • Rule 8(4A), further provisoApplicants who do not choose Aadhaar authentication, other than notified exempt persons, must complete photographs and original-document verification at a notified Facilitation Centre. Their applications become complete only on successful verification.

Procedure, powers and definitions

  • Rule 8(1)Applicants declare their Permanent Account Number and State or Union territory in Part A of FORM GST REG-01. Non-resident taxable persons, tax deductors, tax collectors and the specified overseas online-service and online-money-gaming suppliers are excluded from this route. Input Service Distributors apply separately.
  • Rule 8(2)–(4)The portal validates the Permanent Account Number and verifies its linked mobile and email through separate passwords. The resulting temporary reference number enables signed or electronically verified Part B of FORM GST REG-01 with the required documents.
  • Rule 8(4A)For applicants choosing Aadhaar authentication, excluding persons notified under section 25(6D), submission is dated at authentication or fifteen days after Part B submission, whichever is earlier. Risk-selected applicants must complete biometric authentication, photographs and original-document verification at a notified Facilitation Centre.
  • Rule 8(4B)The Government may notify States or Union territories where the proviso to sub-rule (4A) does not apply, on the Council’s recommendations.
  • Rule 8(5)–(6)Acknowledgement is issued electronically in FORM GST REG-02. For a casual taxable person, the portal provides a temporary reference number for the section 27 advance deposit, and acknowledgement follows only after that deposit.
  • Rule 8(4B)The law does not settle whether territorial exclusion reaches the further proviso added from 11 February 2025 or only the earlier biometric proviso.

Applicants under section 25 use rule 8 to submit registration particulars and documents, subject to the listed exclusions. Input Service Distributors apply separately. Aadhaar authentication and verification requirements vary with the applicant’s choice and risk selection, subject to territorial notifications. Casual taxable persons receive acknowledgement only after the advance tax deposit. Filing the form alone does not complete applications requiring further verification.[1]

Unsettled questions

The words of Rule 8 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Does a territorial exclusion under rule 8(4B), which refers to the proviso to sub-rule (4A), also reach the further proviso added with effect from 11 February 2025, or only the earlier biometric proviso? The applicable notification and amendment history require legal review.
