At a glance

Bars, duties and time limits

  • Rule 3(3)An existing registered person files FORM GST CMP-02 before the relevant financial year and FORM GST ITC-03 under rule 44(4) within sixty days from its commencement. For 2020-21, the specified deadlines were 30 June 2020 and 31 July 2020 respectively.
  • Rule 3(4)A person using FORM GST CMP-01 furnishes FORM GST CMP-03 with stock details, including goods received from unregistered persons, for the preceding day. The period is ninety days from exercise of the option, subject to extension.

Procedure, powers and definitions

  • Rule 3(1)A provisionally registered person files signed or electronically verified FORM GST CMP-01 before the appointed day or within thirty days afterwards, subject to extension. A later filing requires bills of supply and no tax collection from the appointed day.
  • Rule 3(2)An applicant may select the composition option in Part B of FORM GST REG-01. That selection counts as the intimation.
  • Rule 3(3A)The special route overrides the ordinary intimation routes. Eligible persons filing FORM GST CMP-02 by 31 March 2018 could opt from the following month and furnish FORM GST ITC-03 within one hundred and eighty days of starting composition. FORM GST TRAN-1 cannot follow that statement.
  • Rule 3(5)An intimation under sub-rule (1), (3) or (3A) for a place of business applies to all other places registered on the same Permanent Account Number.

Rule 3 sets out how a person opts for the composition levy under section 10. The route depends on whether the person has provisional registration, applies for registration or is already registered. Intimations extend across registrations on the same Permanent Account Number. A special historical option overrides the ordinary routes, and separate statements address credit and opening stock.[1]
