Rule 89 provides the RFD-01 application route for specified refunds and the supporting evidence required by claim type. The general route excludes section 55 notification beneficiaries and integrated tax paid on goods exports, and remains subject to Rule 10B. Special provisions identify the claimant for SEZ and deemed-export supplies. Separate applications address wrong tax classification and additional tax after export-price revision.[1]

The applicant supplies applicable evidence, addresses the incidence-of-tax requirements and debits the credit ledger when claiming input-credit refund. The rule sets different maximum-refund calculations for zero rated supplies without tax payment and inverted duty structure. Those calculations use different meanings of Net ITC. Sub-rule (4) gives the formula for zero-rated supplies and sub-rule (5) the formula for an inverted duty structure.

Notification No. 20/2024-CT omitted the earlier special refund sub-rules and the exclusions that referred to them. Sub-rules (1A) and (1B) each allow two years, with a proviso for payments or relevant dates before the sub-rule came into force.

Sub-rule (4)

89(4)(A)-(C)Zero-rated formula and goods value

Refund Amount = (Turnover of zero-rated supply of goods + Turnover of zero-rated supply of services) x Net ITC ÷ Adjusted Total TurnoverRule 89(4)(A)-(C)

This formula caps the refund of input tax credit on zero-rated supplies made without payment of tax under bond or letter of undertaking; "Refund amount" is the maximum refund admissible. Net ITC here is input tax credit availed on inputs and input services during the relevant period. Turnover of zero-rated goods is the lower of their value and 1.5 times the value of like goods domestically supplied by the same or a similarly placed supplier, as declared by the supplier. The rule does not define like goods or a similarly placed supplier.

89(4)(D)Zero-rated services turnover

reduced by advances received for zero-rated supply of servicesRule 89(4)(D)

The calculation adds relevant-period receipts and completed supplies paid in advance in earlier periods. It deducts advances for services not completed during the relevant period.

89(4)(E)-(F)Adjusted turnover and claim period

excluding the value of exempt supplies other than zero-rated supplies during the relevant periodRule 89(4)(E)-(F)

Adjusted turnover combines the specified goods-side State or Union territory turnover with the defined zero-rated and other services turnover. The relevant period is the period claimed.

89(5)Inverted-duty calculation

Maximum Refund Amount = {(Turnover of inverted rated supply of goods and services) x Net ITC Adjusted Total Turnover} - {tax payable on such inverted rated supply of goods and services x (Net ITC ÷ ITC availed on inputs and input services)}Rule 89(5)

This formula caps the refund of input tax credit for an inverted duty structure. Net ITC here means input tax credit availed on inputs only, and Adjusted Total Turnover and relevant period have their sub-rule (4) meanings. The CBIC text prints no division sign between Net ITC and Adjusted Total Turnover in the first term; sub-rule (4) prints the same terms as Net ITC ÷ Adjusted Total Turnover.
