Entitlement and conditions

  • Rule 91(1)The claimant must not have been prosecuted during the five years immediately preceding the claim’s tax period for an offence under the Act or existing law involving tax evasion exceeding two hundred and fifty lakh rupees.

Procedure, powers and definitions

  • Rule 91(2)The officer uses system risk identification and evaluation to issue FORM GST RFD-04 within seven days of rule 90 acknowledgement. Written reasons permit proceeding under rule 92 instead. The provisional order requires no revalidation.
  • Rule 91(3)–(4)FORM GST RFD-05 authorises payment to an applicant bank account included in registration particulars and specified in the application, through consolidated payment advice. A payment order undisbursed in its issue financial year requires revalidation. The Central Government disburses on the consolidated advice.

Rule 91 governs provisional refunds under section 54(6), subject to the specified prosecution condition. The officer makes a provisional order using system risk identification and evaluation, but may instead proceed under rule 92 with written reasons. Payment follows through the stated bank-account and consolidated-advice process. The provisional sanction needs no revalidation, while an undisbursed payment order can require it.[1]

Unsettled questions

The words of Rule 91 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. No silent question is replaced by a firm-policy fact; external legal prescriptions remain dependencies.
