GST›CGST Rules, 2017›Chapter IX, Payment of Tax

At a glance

Rule 88B calculates interest under section 50 through separate tax-payment and credit-utilisation routes. A qualifying late return for supplies of the same period uses the cash-paid tax portion, with an exception for returns filed after the stated proceedings begin. Other section 50(1) cases use unpaid tax. Wrongly availed and utilised credit follows the separate section 50(3) calculation.[1]

The late-return proviso excludes qualifying cash credited by the due date and continuously lying in the ledger until its tax debit on filing. For wrong credit, utilisation depends on the credit-ledger balance falling below the wrongly availed amount. The explanation fixes both the extent and date of utilisation. The relevant notified section 50 rate remains a separate requirement.

The insertion footnote names Notification No. 14/2022-CT, while the later cash-ledger proviso names Notification No. 12/2024-CT. The section 74A proceedings reference is footnoted from 1 November 2024. These additions should be matched to the relevant period before choosing a calculation route. The rule supplies different bases and periods rather than a single interest calculation for every case.
