Rule 97 governs receipts, payments and administration of the Consumer Welfare Fund. It provides for claimant payments ordered by the proper officer, appellate authority or court, and audit of the Fund’s accounts. A Standing Committee recommends consumer welfare grants and investments, scrutinises applications and monitors use of assistance. The rule also earmarks an annual share for GST publicity or consumer awareness, subject to a funding safeguard.[1]

Unsettled questions

The words of Rule 97 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. What falls within other monies received by it under section 57(c), without inferring a residual classification?
  2. What documented circumstances make Committee meetings necessary under 97(5)(a), and how should generally four times in a year inform that assessment when the actual interval makes the outcome turn on it? No fixed count or cadence is adopted.
