GST›CGST Rules, 2017›Chapter X, Refund

At a glance

Rule 96 treats the goods-export shipping bill as the refund application only after specified filing and authentication conditions are met. It coordinates export-invoice information, Customs confirmation and valid GSTR-3B information before processing. A mismatch can shift the deemed filing date to rectification. Service-export claims and additional tax after an export-price revision instead follow the RFD-01 procedure under Rule 89.[1]

The goods-refund mechanism credits the prescribed bank account after processing by Customs. Withholding grounds include a jurisdictional Commissioner’s request under section 54, a Customs-law violation and specified revenue-risk verification. Certain withheld claims move electronically to the proper tax officer as system-generated RFD-01 applications, with overriding deemed-filing rules. They are then dealt with under Rule 89 rather than the ordinary Customs processing route.

The footnotes identify successive amendments to return, authentication and withholding procedures, including later additions for export-price revision. The selected wording omits the earlier sub-rule concerning specified procurement benefits. Deleted withholding procedures also remain only as amendment history. Their former forms and steps should not be restored as additional operative requirements alongside the system-generated application procedure now set out.

Frequently asked questions

Does filing a shipping bill alone complete the deemed application?

Sub-rule (1) also requires the specified manifest or report, valid GSTR-3B and Rule 10B authentication. A relevant mismatch engages the rectification-date proviso.

Rule 96(1)

How are specified withheld claims taken forward?

The stated transmission routes create system-generated RFD-01 applications deemed filed on transmission, with electronic intimation. Rule 89 then governs processing.

Rule 96(5A)-(5C)

Do service exports use the same shipping-bill route?

Sub-rule (9) requires RFD-01 for service-export integrated-tax refunds and applies Rule 89.
