Bars, duties and time limits

  • Rule 6(1)–(3)When a condition ceases to be satisfied, the person must apply section 9(1), issue tax invoices for subsequent taxable supplies and file FORM GST CMP-04 within seven days. Voluntary withdrawal requires electronic FORM GST CMP-04 before the withdrawal date.

Procedure, powers and definitions

  • Rule 6(4)–(5)The officer may issue FORM GSTCMP-05 on reasons to believe ineligibility or contravention. The person has fifteen days from receipt to show cause in FORM GST CMP-06. The officer issues FORM GST CMP-07 within thirty days of receiving the reply, accepting it or denying the option from the applicable date.
  • Rule 6(6)A person withdrawing or denied the option may furnish FORM GST ITC-01 for inputs and inputs in semi-finished or finished stock on the withdrawal or denial date. The period is thirty days from withdrawal or the denial order, as applicable.
  • Rule 6(7)Withdrawal or denial for any place of business applies to other places registered on the same Permanent Account Number.
  • Rule 6(4)The law does not settle what evidence establishes the officer’s reasons to believe ineligibility or contravention.

A composition option remains valid only while the registered person satisfies section 10 and the rules. Loss of eligibility triggers ordinary taxation, tax invoices and withdrawal intimation. A person may also withdraw voluntarily, while the proper officer can deny the option through notice and an order. Withdrawal or denial extends across places of business registered on the same Permanent Account Number.[1]
