At a glance

Bars, duties and time limits

  • 154(2)If the balance cannot be paid within six months from sale or a further period allowed by the proper officer, it must be deposited with the Fund.

Procedure, powers and definitions

  • 154(1)(a)–(c)Proceeds first meet administrative recovery costs, then the amount under recovery or section 129(3) penalty, and then other dues under the specified GST enactments and rules.
  • 154(1)(d)The balance is credited to the goods or conveyance owner’s electronic cash ledger if registered. Where that person is not required to register, it is credited to the person’s bank account.

Rule 154 sets the order for applying sale proceeds recovered from a defaulter or towards a section 129 penalty. Recovery costs take priority, followed by the targeted amount and other GST dues. Any balance goes through the specified cash-ledger or bank route. If payment of that balance remains impossible within the permitted period, it must be deposited in the Fund.[1]
