Bars, duties and time limits

  • Rule 62(1)–(3)FORM GST CMP-08 is due by the eighteenth day after the relevant quarter ends. FORM GSTR-4 includes invoice-wise inward supplies from registered and unregistered persons and consolidated outward supplies. Tax and interest are paid by debiting the cash ledger.
  • Rule 62(1), annual returnThe ordinary text states the thirtieth day of April after the financial year. The further proviso requires the annual FORM GSTR-4 by the thirtieth day of June for FY 2024-25 onwards.
  • Rule 62(4)A person entering composition from the financial-year start must, where required, furnish prior-period details and returns under rules 59, 60 and 61 by the stated September-return due date or earlier annual-return filing. The explanation bars credit on receipt of supplier invoices or debit notes for the pre-composition period.
  • Rule 62(5)On voluntary or officer-directed withdrawal, the text requires FORM GST CMP-08 by the eighteenth day after the withdrawal quarter and FORM GSTR-4 for the composition period by the thirtieth day of April after that financial year.

Procedure, powers and definitions

  • Rule 62(1) and (5)The law does not settle how the June deadline from FY 2024-25 interacts with the unchanged April wording for a withdrawal-period FORM GSTR-4.

Composition taxpayers furnish quarterly payment statements and annual returns under rule 62. FORM GST CMP-08 reports self-assessed payments, while FORM GSTR-4 carries the annual supply details. The general annual deadline changes to June from FY 2024-25. The withdrawal provision still states April, leaving an unresolved interaction. Tax and interest under the statement are discharged through the electronic cash ledger.[1]

Unsettled questions

The words of Rule 62 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. How does the FY2024-25-onwards June proviso after Rule 62(1), together with amended GSTR-4 instructions, interact with the unchanged April wording of Rule 62(5) for a withdrawal-period GSTR-4? No answer is adopted; applicable period and notifications require professional confirmation.
