At a glance

Entitlement and conditions

  • Rule 11(1)The person must have more than one place of business within the statutory definition. No place can use section 10 while another uses section 9. Loss of composition eligibility at one separately registered place makes the other registered places ineligible too.

Bars, duties and time limits

  • Rule 11(1)(c)Separately registered places must pay tax under the Act on supplies to another registered place of the same person and issue a tax invoice or bill of supply, as applicable.

Procedure, powers and definitions

  • Rule 11(2)–(3)A separate FORM GST REG-01 is required for each place. Rules 9 and 10 apply with the corresponding changes for verification and grant of registration.
  • Rule 11(3)The law does not settle which corresponding changes to the verification and certificate procedures are required for this special application.

A person with multiple places of business in a State or Union territory can obtain separate registration for those places under section 25(2), subject to rule 11. The person cannot combine composition at one place with ordinary taxation at another. Separately registered places must treat supplies between themselves under the Act and issue the required tax invoice or bill of supply.[1]

Unsettled questions

The words of Rule 11 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Which corresponding changes to Rule 9 verification and Rule 10 grant or certificate procedures are needed for the selected special registration application under Rules 11, 13 or 16? Each invokes mutatis mutandis without enumerating those changes.
