At a glance

Entitlement and conditions

  • Rule 31, provisoA supplier of services may choose rule 31 while bypassing rule 30.

Procedure, powers and definitions

  • Rule 31If rules 27 to 30 cannot determine value, reasonable means consistent with section 15 and this Chapter must be used.
  • Rule 31The law does not settle mechanically whether the actual means used are reasonable for a particular supply.

Rule 31 provides a residual valuation method when rules 27 to 30 cannot determine value. The method must use reasonable means consistent with section 15 and the valuation Chapter. A supplier of services may choose this route without using rule 30 first. The rule leaves the reasonableness of the selected means to assessment in the particular supply.[1]

Unsettled questions

The words of Rule 31 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Are the actual means used reasonable for this selected supply? The statute provides no mechanical measurement for this question.
