Procedure, powers and definitions

  • Rule 35The tax amount is the tax-inclusive value multiplied by the relevant integrated, central, State or Union territory tax percentage, divided by 100 plus the sum of applicable tax percentages.
  • Explanation (a)Open market value is the full money value excluding the specified GST taxes and cess, between unrelated parties where price is the sole consideration, for the same supply at the time of the supply being valued.
  • Explanation (b)Like-kind-and-quality supplies arise in similar circumstances and are the same as, or closely or substantially resemble, the valued supply in characteristics, quality, quantity, functional components, materials and reputation.

Rule 35 extracts the tax component from a price that already includes the specified GST taxes. Its formula uses the tax-inclusive value, the relevant percentage rate and the sum of applicable rates. The accompanying explanation also defines open market value and supplies of like kind and quality for the valuation Chapter, giving the comparison basis used by its other rules.[1]
