  • 159The law does not settle the interval for forthwith release, what hearing opportunity suffices, or what material establishes that property is no longer liable to attachment.

Rule 159 prescribes provisional attachment and release procedures under section 83, including for bank accounts. The Commissioner identifies the attached property and arranges an encumbrance, which ends on written instructions or the specified annual expiry, whichever occurs earlier. Special payment and disposal rules apply to perishable or hazardous property. An affected person may object, and the Commissioner may release property no longer liable to attachment.[1]

Unsettled questions

The words of Rule 159 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. What interval after proof of the applicable payment satisfies forthwith release under Rule 141(1) or159(3)?
  2. What procedural opportunity suffices for the attached-property objector to be heard under Rule 159(5)?
  3. What material suffices for the Commissioner to be satisfied that the property was or is no longer liable for attachment under Rule 159(6)?
