It concerns export proceeds not received in convertible foreign exchange or permitted Indian rupees.

Procedure, powers and definitions

  • 96A(2)Export invoice details in FORM GSTR-1, including amendments in FORM GSTR-1A, pass electronically to Customs for export confirmation. Where the outward supply filing date is extended, Table 6A information follows FORM GSTR-3B and is auto-drafted into FORM GSTR-1.
  • 96A(3)–(5)Failure both to export goods within time and to pay the required amount triggers withdrawal and recovery under section 79. Payment restores the facility. The Board may notify conditions for a Letter of Undertaking in place of a bond.
  • 96AThe law does not settle the precise adaptations for a selected Special Economic Zone supply or the timing meant by forthwith withdrawal and immediate restoration.

Rule 96A requires a registered exporter choosing export without integrated tax to furnish a bond or Letter of Undertaking before export. The undertaking covers tax and interest if goods are not exported or service payments are not received within the prescribed periods. The rule also provides for Customs confirmation, withdrawal and restoration of the facility, and adaptation for specified Special Economic Zone supplies.[1]

Unsettled questions

The words of Rule 96A do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Which adaptations of the export, invoice and payment conditions in subrule(1) are necessary for the selected zero-rated SEZ supply? Rule 96A(6) invokes mutatis mutandis without enumerating them; IGST20 and registration-procedure positions address different provisions.
  2. What timing satisfies forthwith withdrawal under 96A(3), measured from the established goods-export and payment default, where the actual interval makes the outcome turn on that undefined standard?
  3. What timing satisfies restoration immediately when the amount due is paid under 96A(4), where the actual payment-to-restoration interval makes the outcome turn on that undefined standard?
