Entitlement and conditions

  • 133(3)(c)Where the eligible person does not claim return or cannot be identified, the rule provides for fifty per cent in the Central Fund and the remaining fifty per cent in the concerned State or Union Territory Fund. The inserted interest requirement runs from collection until deposit.

Procedure, powers and definitions

  • 133(1)–(2A)The Authority must determine whether the benefit was passed on within six months of receiving the investigation report. Interested parties receive a hearing on written request, and the Authority may seek clarification from the Director General.
  • 133(3)(a)–(b)On finding that the benefit was not passed on, the Authority may order price reduction and return of the relevant amount with eighteen per cent interest from collection until return, or recovery of the unreturned amount including interest.
  • 133(3)(d)–(e)The Authority may also order penalty as specified under the Act and cancellation of registration under the Act.
  • 133(4)Whether the report recommends contravention or non-contravention, the Authority may refer the matter for further investigation or enquiry, with written reasons.
  • 133(5)Notwithstanding the further-investigation provision, reasons to believe that other goods or services involve contravention permit a written direction within the six-month period. This is treated as a new investigation, with rule 129 applying with necessary changes.
  • 133The law does not settle the interest base and allocation between Funds, the time basis, day-count denominator and rounding, or the precise adaptations required for a new investigation.

Rule 133 governs the Authority’s determination after an anti-profiteering investigation report. It sets a decision period, provides a hearing on written request and permits clarification or further investigation. Where the Authority finds that a tax or credit benefit was not passed on, it may order the specified remedies. A separate power covers investigation of other goods or services.[1]

Unsettled questions

The words of Rule 133 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Under Rule 133(3)(c), how is the interest base and allocation between Central and concerned State/UT Funds determined by the inserted interest phrase and remaining fifty per cent wording?
  2. What time basis, day-count denominator and rounding apply to the eighteen-percent interest in Rules 127 and133 where the rule does not state them?
  3. Which procedural adaptations to Rule 129 does mutatis mutandis permit or require when an investigation under Rule 133(5)(a) is treated as new under Rule 133(5)(b)?
