Entitlement and conditions

  • Rule 21A(4), further provisosBefore cancellation, suspension under sub-rule (2A) for the specified return defaults is deemed revoked when all pending returns are furnished. Suspension for rule 10A non-compliance is deemed revoked upon compliance with that rule.

Bars, duties and time limits

  • Rule 21A(3)–(3A)During suspension, the person must not issue tax invoices or charge tax and need not furnish section 39 returns. Section 54 refunds cannot be granted during suspension under sub-rule (2) or (2A).

Procedure, powers and definitions

  • Rule 21A(1)–(2)A cancellation application suspends registration from submission or the requested cancellation date, whichever is later. An officer with reasons to believe cancellation is warranted under section 29 or rule 21 has power to suspend from a determined date pending rule 22 proceedings.
  • Rule 21A(2A)Significant return or supply-detail discrepancies indicating cancellation-leading contravention, or breach of rule 10A, trigger suspension and FORM GST REG-31. The notice identifies the issues and requires an explanation within thirty days. The comparison includes the specified FORM GSTR-1A adjustments.
  • Rule 21A(4)Completion of rule 22 proceedings revokes suspension from its original effective date. The officer may also revoke it while proceedings remain pending.
  • Rule 21A(5)An order revoking suspension brings the section 31(3)(a) and section 40 procedures into operation for supplies made during suspension.
  • Rule 21AThe law does not settle fact-specific significance of discrepancies, whether contraventions warrant cancellation, or the application of officer powers and referenced procedures.

Rule 21A suspends registration while cancellation proceedings continue. Suspension can follow a cancellation application, an officer’s decision or specified discrepancies and non-compliance. During suspension, the person must not issue tax invoices or charge tax, and section 39 returns are not required. Refund restrictions apply to specified suspension routes. Revocation can follow completion, an officer’s earlier decision or the stated corrective compliance.[1]

Unsettled questions

The words of Rule 21A do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. No new firm position is inferred from ordinary evidential judgement. Significance, cancellation-leading contravention, officer power and the referenced Act/rule procedures remain visible human judgements.
