At a glance

Entitlement and conditions

  • Rule 90(5)–(6)FORM GST RFD-01W permits withdrawal before issuance of the specified provisional sanction, final sanction, payment, withholding order or rejection notice. Submission restores the refund-related debit to the same cash or credit ledger.

Procedure, powers and definitions

  • Rule 90(1)–(2)FORM GST RFD-02 identifies the filing date from which section 54(7)’s period runs. For non-cash-ledger refunds, the officer scrutinises completeness under rule 89(2), (3) and (4) within fifteen days of filing before acknowledgement.
  • Rule 90(3)–(4)Deficiencies are communicated through FORM GST RFD-03 and require a fresh application after correction. The interval from the original FORM GST RFD-01 filing to deficiency communication is excluded from section 54’s two-year limitation for that fresh claim. State-rule deficiency communication is also deemed communicated here.
  • Rule 90(2)–(3)The law does not settle mechanically whether a particular application is complete or whether a particular limitation calculation correctly excludes the filing-to-deficiency interval.

Rule 90 governs acknowledgement, completeness checks and withdrawal of refund applications. Cash-ledger claims receive an electronic acknowledgement stating the filing date. Other claims undergo scrutiny for completeness. Deficiencies require a fresh corrected application, with the stated interval excluded from limitation. An applicant may withdraw before the listed orders or notice are issued, and the related ledger debit is then restored.[1]

Unsettled questions

The words of Rule 90 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Is the application complete in terms of Rule 89(2), (3) and (4)? The statute provides no mechanical measurement for this question.
  2. Does the limitation working exclude the period from that filing to that deficiency communication? The statute provides no mechanical measurement for this question.
