Procedure, powers and definitions

  • Rule 92(1)–(1A)FORM GST RFD-06 states the sanctioned amount, provisional refund, demand adjustments and balance. For tax refunds other than zero-rated or deemed-export refunds, cash is proportionate to cash used for the relevant tax payment; the credit-funded remainder is restored through FORM GST PMT-03.
  • Rule 92(2)Withholding under section 54(10) or (11) requires reasons in Part A of FORM GST RFD-07. When withholding is no longer warranted, the officer or Commissioner may release it through Part B.
  • Rule 92(3)Proposed rejection requires written reasons and FORM GST RFD-08, with fifteen days from receipt to reply in FORM GST RFD-09. After considering the reply, the officer sanctions or rejects through FORM GST RFD-06. No rejection can occur without a hearing opportunity.
  • Rule 92(4)–(4A)Where section 54(8) permits payment to the applicant, FORM GST RFD-05 and consolidated payment advice support Central Government disbursement to the specified bank account. The sanction order needs no revalidation, but an undisbursed payment order requires revalidation after its issue financial year.
  • Rule 92(5)Where the refund is not payable to the applicant under section 54(8), the sanction and payment orders direct the amount to the Consumer Welfare Fund.

Rule 92 governs final refund sanction, withholding, rejection and payment. The officer accounts for provisional refunds and outstanding demands before determining the balance. Certain tax refunds are split between cash payment and credit restoration. A proposed rejection requires notice and a hearing opportunity. The final destination depends on whether section 54(8) permits payment to the applicant or the Consumer Welfare Fund route applies.[1]

  1. No silent question is replaced by a firm-policy fact; external legal prescriptions remain dependencies.
