GST›CGST Rules, 2017›Chapter VI, Tax Invoice, Credit and Debit Notes

At a glance

Rule 53 prescribes revised tax invoice and credit or debit note particulars. It separates the revised invoice under section 31 from a note under section 34, including their links to the original documents. Registration effective before certificate issuance permits revision for the intervening taxable supplies. Consolidated revision has separate unregistered-recipient and inter-State conditions, alongside the linked Rule 54(5) exception.[1]

Revised invoices identify their revised character, parties, serial number, issue date and corresponding original document. Credit or debit notes additionally state the document’s nature, taxable value, tax rate and tax credited or debited. The specified documents connected with sections 74, 129 or 130 must prominently carry the credit-prohibition words. Prominence does not have a fixed font, size or placement here.

The footnotes state that the omissions from the earlier combined particulars and insertion of the separate credit-or-debit-note sub-rule took effect on 1 February 2019. The revised invoice and note requirements should therefore be read separately in this wording. The registration-period revision permission also remains distinct from the exceptions permitting consolidation of supplies to unregistered recipients during that period.

Unsettled questions

The words of Rule 53 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. When the recipient address and delivery address lie in different States, which address determines the State name and code required alongside them? The clause lists both addresses and says along with the name of State and its code without identifying the controlling address; no priority is adopted. Authorities unverified.
  2. Existing document-prominence position reused; widen from tax amount to the mandatory designation or legend within the tax document, preserving the existing amount question. No fixed font, size or placement is invented; proposed status and human assessment remain.
