Entitlement and conditions

  • Rule 55(1)A challan may replace an invoice for the stated liquid-gas case, job work, non-supply movements or other Board-notified supplies. Its serial number must not exceed sixteen characters.

Bars, duties and time limits

  • Rule 55(1)(i)–(ix)The challan includes number and date, parties and registration particulars, classification and description, quantity, taxable value and signature. Quantity may be provisional. Supply movements require tax details, and inter-State movements require place of supply.
  • Rule 55(5)For knocked-down goods or batches or lots, the complete invoice precedes the first dispatch. Later consignments require invoice-referencing challans; each consignment carries the corresponding challan copies and a certified invoice copy. The original invoice travels with the final consignment.

Procedure, powers and definitions

  • Rule 55(2)–(4)For supply, copies are marked ORIGINAL FOR CONSIGNEE, DUPLICATE FOR TRANSPORTER and TRIPLICATE FOR CONSIGNER. Movement under a challan must be declared under rule 138. If a supply invoice could not issue at removal, it must issue after delivery.
  • Rule 55(5)(c)The law does not settle who may certify the invoice copy or the required manner of certification.

A consignor may use a delivery challan instead of an invoice for the movements specified in rule 55. These include job work, non-supply movements and liquid gas whose quantity is unknown at removal. The challan carries the prescribed details and accompanies the relevant declaration. Split consignments have additional document requirements, while supply movements without an invoice require an invoice after delivery.[1]

Unsettled questions

The words of Rule 55 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. Who may certify the invoice copy and what certification makes it duly certified for Rule 55(5)(c)? The provision fixes neither certifier nor manner. Authorities unverified; no standard adopted.
