Entitlement and conditions

  • 142(3)Qualifying payments under sections 73, 74 or 74A within their specified periods are intimated in FORM GST DRC-03 and followed by FORM GST DRC-05 concluding the notice proceedings. For section 129, payment must be within seven days of the notice and before the order.

Bars, duties and time limits

  • 142(1)The proper officer serves FORM GST DRC-01 with notices under the specified sections and FORM GST DRC-02 with the specified statements under sections 73, 74 or 74A, giving the amount details.
  • 142(2)A person making the specified pre-notice or other statutory payments informs the officer through FORM GST DRC-03. FORM GST DRC-04 acknowledgement is made available electronically on the portal.
  • 142(4)The specified representations and replies to notices whose summaries were uploaded in FORM GST DRC-01 must be furnished in FORM GST DRC-06.
  • 142(7)The officer uploads the summary of a section 161 rectification order or withdrawal of an uploaded order in FORM GST DRC-08.

Procedure, powers and definitions

  • 142(1A) and (2A)Before a specified tax notice, the officer may communicate ascertained amounts in Part A of FORM GST DRC-01A. The person may respond to partial payment or proposed liability in Part B, and the officer may accept payment or submissions through Part C.
  • 142(2B)Where a payment was intimated in FORM GST DRC-03 instead of being credited against a demand entry, FORM GST DRC-03A may seek adjustment against that demand from the original intimation date. This route is barred for a payment already covered by a FORM GST DRC-05 conclusion.
  • 142(5)–(6)The order summary is uploaded in FORM GST DRC-07 specifying the relevant tax, interest and penalty. The order referred to in this requirement is treated as the notice for recovery.

Rule 142 prescribes electronic summaries, payment intimations, replies and order summaries for specified demands under the Act. It distinguishes optional communication before notice from mandatory service and filing steps. Payments may require acknowledgement, adjustment against an existing demand or conclusion of proceedings, depending on the statutory conditions. Rectification and withdrawal of orders also require prescribed electronic summaries.[1]
