At a glance

Entitlement and conditions

  • 124(a)–(b)Failure without reasonable cause, or wilfully furnishing or causing known false information or a return, attracts a fine up to ten thousand rupees.

Bars, duties and time limits

  • 124A continuing offence permits a further fine up to one hundred rupees for each day after the first, subject to a maximum of twenty-five thousand rupees.

Procedure, powers and definitions

  • 124The law does not settle reasonable cause, whether the ceiling covers only the further fine or the total, or the reach of this section after section 151 became an information-only power.

Failure without reasonable cause to furnish information or a return required under section 151, or wilful furnishing of known false material, attracts a fine. A continuing offence carries a further daily fine subject to the stated ceiling. The section leaves both reasonable cause and the allocation of that ceiling unresolved, and its relationship with the substituted information power needs care.[1]

Unsettled questions

The words of section 124 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. What is a reasonable cause for the purposes of clause (a)? The clause makes the absence of one an ingredient and gives no test of it.
  2. Does the maximum limit of twenty-five thousand rupees attach to the further fine alone, or to the fine and the further fine together? The words follow the further-fine limb and the sentence carries both.
  3. Does section 124 reach a failure in respect of a requirement made under the substituted section 151, which calls for information only? Section 124 is headed "Fine for failure to furnish statistics" and speaks of "any information or return", and the substituted section 151 neither collects statistics nor speaks of a return.
