Procedure, powers and definitions

  • 84(a)For enhanced dues, serve another demand for the increase. Existing recovery of the original demand may continue from its prior stage without a fresh notice.
  • 84(b)For reduced dues, give intimation to the person and the authority handling recovery. No fresh demand is needed, and recovery continues from its prior stage for the reduced amount.
  • 84The law does not settle which other proceedings qualify beyond appeal and revision, including rectification or proceedings before courts or under other laws.

The Commissioner must reflect changes to Government dues made in an appeal, revision or other proceeding. An increase needs another demand notice for the additional amount, while recovery of the original demand can continue without a fresh notice. A reduction requires intimation to the person and recovery authority; recovery can continue for the reduced amount from its existing stage.[1]

Unsettled questions

The words of section 84 do not answer this question. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. What does "any other proceedings is initiated in respect of such Government dues" reach? The section names an appeal and a revision application and then leaves the third limb open: whether it takes in a rectification under this Act, a proceeding before a court, or a proceeding under another law is nowhere said.
